In accordance with common article 3(2) of Directive 2000/43/EC and 2000/78/EC, Danish law on the prohibition of discrimination in the labour market and in access to goods and services does not cover nationality (citizenship) as a suspect ground. However, according to the travaux preparatoires, the law offers some protection against indirect discrimination on account of nationality.

Within the area of competence comferred on the European Union, the question of discrimination on account of nationality is regulated by EU law, see. e.g. article 18 TFEU.

A number of cases have been reported relating to discrimination on account of nationality/citizenship.
