According to the Act on the Implementation of Certain Provisions of the EU on Equal Treatment, two public bodies were granted competences in the field of equality and non-discrimination: the Human Rights Defender and the Government Plenipotentiary for Equal Treatment. The Human Rights Defender is an independent authority who has the right to receive and investigate complaints. The Ombudsman examines facts described by a complainant and can apply to another control body for examination of the case if he or she establishes that the principle of equal treatment has been violated. Cases of discrimination based on racial, national or ethnic origin may be also filed in the Monitoring Team on Racism and Xenophobia set up in the Ministry of Interior. A victim of discrimination in employment may also report to the National Labour Inspectorate.

In connection with the division of the Ministry of Interior and Administration into two units – the Ministry of Interior and the Ministry of Administration and Digitization – and the fact of taking over other competences by the Monitoring Centre on Racism and Xenophobia from 23 December, 2011, the body functions as Human Rights Committee. The scope of competences of the new body includes, among others, monitoring cases concerning hate crimes and taking action against such phenomena.
