The Italian Decree (9 luglio 2003, n. 215 “Implementation of the Directive on the equal treatment of persons independently from race and ethnic origin”) is a transposition of the Directive 2000/43. “This Decree – as well as the pre-existing antidiscrimination provisions of immigration law – apply to all persons without requirements of citizenship or nationality. The exclusion of nationality from their field of application – formally in line with the Directives- implies, however, some problems”.
