Ms M. is Austrian Citizen of Turkish origin. She is retired and lives in Vienna. On a Friday afternoon in May 2010 she picks up her granddaughter from school and takes her home. As she and her granddaughter enter the courtyard of the apartment house they meet a woman with her daughter and a dog. The dog doesn’t wear a muzzle and isn’t kept on a leash. The dog frightens Ms M's granddaughter. As Ms M. makes a gesture towards the woman to put her dog on a leash she is called a “foreign whore who should shut up”.
As Ms M. tries to pass the dog the owner and her daughter attack her and hit her with the leash. The granddaughter manages to enter the building and ask her mother for help who calls the police.
After the police arrive they tell Ms M. and her daughter to be quiet and only ask the two attackers to give them an account of the incident.
A few days later Ms M. gives a statement at the police station mentioning explicitly the injuries inflicted on them by the attackers. Also the attackers are reporting the case to the police accusing Ms M. of having started the attack. Upon this report the public prosecutor decides to pursue the prosecution of Ms M. In the subsequent legal proceedings Ms M. is discharged by the court.
